Ordinance n. º 1637/2006
The Law n.º 37/2006, of August 9, ruling the exercise of the right of moving and residing freely of members of the European Union and their family members in the national territory lays down in articles 14.º, 15.º, 16.º e 17.º that the models of the register certificate, the residence card of the family member of the citizen of the European Union, the permanent residence certificate of the citizen of the European Union and the permanent residence card of family member of his/her family member are approved by ordinance from the member of the government responsible for the home affairs. Fees are also established by an ordinance according to the criterion laid down in n.º 4 of article 29.º of the same law. The National Association of Portuguese Municipalities was heard. Thus: The Government, through the Minister of State and Home Affairs, orders:
The model of register certificate mentioned in n.º 3 of article 14.º of Law n.º 37/2006, of August 9, and numbered as Attachment I of the present ordinance and making part of it is approved.
Document and residence card
a) The model of document of permanent residence of citizen of the European Union , mentioned in article 16.º of Law n.º 37/2006, of August 9, as Attachment II of the present ordinance and making part of it;
b) The models of residence card of family member of the European Union when national from a third State, mentioned, respectively, in articles 15.º and 17.º of the referred law, and numbered as Attachments III and IV of the present ordinance and making part of it.
1—For the issuing of each of the documents mentioned in articles 1.º e 2.º of the present ordinance a fee of €7,00 is due.
2— In case of deviation, theft or deterioration of the certificates, documents and cards mentioned in the present ordinance, the fee due for the issuing is of € 7,50.
Distribution of fees
1—The proceeds of the fees on the register certificate mentioned in article 1.º of the present ordinance are distributed by the municipalities and Serviço de Estrangeiros e Fronteiras, according to the stipulations of n.º 2 of article 29.º of the Law n.º 37/2006, of August 9.
2— The amount to be charged by the municipality’s part of the service provided is settled according to the legislation applicable to municipalities, by the qualified bodies to settle municipal fees, and without exceeding 50% of the value mentioned in article 3.º
3— In order to cover municipal administrative expenses, an amount of 2,5% is deducted from the amount due to Serviço de Estrangeiros e Fronteiras.
The first issuing of the certificate, the permanent residence document or the residence card of citizens under the age of 18 is free, under the legal arrangements mentioned in the preceding articles.
1—The personalisation and the issuing of documents approved by this ordinance are assured in partnership both by municipal councils and Serviço de Estrangeiros e Fronteiras.
2—Serviço de Estrangeiros e Fronteiras assures the creation and management of the indispensable information system and network to registry, electronic transmission of data, and invoicing of the registries according to the stipulations of the Law n.º 37/2006, of August 9, including the production of computer programs, the definition of equipment specifications to be used and technical support.
