Renovation of Residence Permit

Renovation of Temporary Residence Permit (Article 78 of Act 23/2007)

 

The renovation of temporary residence permit must be requested by the interested parties up to thirty days before the terminus of its time limit.

 

The residence permit is valid for one year period as of the issue date of the respective title and is renewable for successive periods of two years.

 

Attention:

 

Nonetheless, the residence title must be renewed whenever occurs an alteration of the identification elements.

 

Preparation of the Request

 

* In the Regional Directorship or Delegation of SEF – Serviço de Estrangeiros e Fronteiras of the residence area.

Common Documents:

- Valid Residence Title, or expired up to six months;

- Request presented in person, in due form, signed by the applicant (in case of a minor or disabled, the request must be signed by the respective legal representative);

- Two recent, identical photographs, in colour with white background, and easily identifiable, if necessary;

- Passport or any other valid travelling document;

- Evidence of subsistence means (those benefiting from scholarship are exempted)

- Evidence of accommodation;

- Request for search of criminal record by SEF;

- An internal inquiry in order to check the legal fulfilments of fiscal and social security must be made, as provided in paragraph 9 of Article 212 of Act 23/2007 of July 4.

 

 

Specific Documents:

The particularities of each residence permit in the renewal act must be considered.

Namely:

 

Second Issuance of Residence Title (Article 73 of the RD):

 

- The renovation of the residence title by alteration of the identification elements by theft, loss or deterioration is made by the expiry date of the previous. The citizen must provide evidence of alteration of the identification elements, as well as a legal document which testifies theft, loss or deterioration;

 

Residence permit for carrying out a subordinated professional activity (Article 88 of the Law)

 

- Work contract or a declaration from the employer entity confirming the prolongation of the labour relation; or from any other legally authorized entity.

 Residence permit for carrying out an independent professional activity (Article 89 of the Law)

 

- Contract for providing services within the ambit of a liberal profession or request for the corroboration of the IRS declaration in the tributary administration, in order to confirm the maintenance of the activity;  

Residence permit for research or highly qualified activity (Article 90 of the Law)

 

- Work contract or declaration of the employer entity confirming the continuity of the labour relation; or

 

- Contract for providing services within the ambit of a liberal profession or declaration of the beneficiary confirming the continuity of the contract; or evidence of holding a scientific research allowance;

 

Residence permit granted to high level students (Article 91 of the Law)

 

- Document confirming the registration in the teaching institution and evidence of school activity (whenever there is no progress or transition to the next school year, the procedure will be subject of inquiry);

- Evidence of payment of the fees charged by the teaching institution, whenever applicable;

- Health insurance or any evidence that the applicant benefits from the national health service;

- Whenever authorized to work, a work contract or declaration of the employer entity confirming the maintenance of the labour relation or of any other legally authorized entity;

- Scholarship beneficiaries from IPAD – the Portuguese Institute for Development Assistance - merely need to present evidentiary document of scholarship.

 

 

Residence permit granted to secondary level students (Article 92 of the Law)

 

- Document confirming the registration in the teaching institution and evidence of school activity (whenever there is no progress or transition to the next school year, the procedure will be subject of inquiry);

- Evidence of payment of the fees charged by the teaching institution, whenever applicable;

- Health insurance or any evidence that the applicant benefits from the national health service;

- Whenever authorized to work, a work contract or declaration of the employer entity confirming the maintenance of the labour relation or of any other legally authorized entity;

- Scholarship beneficiaries from IPAD – the Portuguese Institute for Development Assistance - only need to present evidentiary document of scholarship.

 

Residence permit for unremunerated trainees (Article 93 of the Law)

 

- Evidence of the situation’s exceptionality issued by the entity or company responsible for the internship;

 

Residence permit for voluntaries (Article 94 of the Law)

 

- Residence permit for voluntaries is not renewable.

 

Right to family reunion (Article 98 of the Law)

 

- Evidence of familiar union maintenance;

- Evidence that the applicant has accommodation;

- Evidence that the applicant has subsistence means; and

- Request for Portuguese criminal record search;

 

Autonomous Residence permit, after family reunion (Article 107 paragraphs 3, 4 and 5 of the Law)

 

- In addition to the specific documents provided in Article 98 a document which evidences the invoked situation;

 

Residence permit issued to victims of trafficking in human beings (article 109 of the Law)

 

- The Residence Permit is renewable for one year periods while the conditions still meet or if there is still need of protection of the person identified as victim of trafficking in human beings;

 

Residence Permit for holders of long-term resident status in other Member State of the European Union (Article 116 of the Law)

 

- Work contract (in compliance with paragraph 3 of Article 63 of the Regulatory Decree);

- Society contract or a contract for providing services within the ambit of a liberal profession (in compliance with paragraph 3 of Article 63 of the Regulatory Decree);

- Evidence of registration in a high level teaching institution or in an institution or company of professional training officially recognized;

 - Presents a reason in accordance with the provisions on sub-heading d), paragraph 1 of Article 116 of Act 23/2007 from July 4.

 

 

Permanent residence permit granting (Article 80 of Act 23/2007)

 

Preparation of the Request

 

*In the Regional Directorship or Delegation of SEF – Serviço de Estrangeiros e Fronteiras of the residence area.

 

Common Documents:

 

- Request presented in person, in due form, signed by the applicant (in case of a minor or disabled, the request must be signed by the respective legal representative);

- Two recent, identical photographs, in colour with white background, and easily identifiable, if necessary;

- Passport or any other valid travelling document;

- Evidence of subsistence means:

- Evidence of accommodation;

- Request for search of criminal record by SEF;

- Previous temporary residence title;

- An internal inquiry in order to check the legal fulfilments of fiscal and social security must be made, as provided on paragraph 9 of Article 212 of Act 23/2007 of July 4.

 - School certificate issued by a Portuguese official teaching establishment (or an official Portuguese language Country) either public, private or cooperative recognized in compliance with the Law, a certificate of progress in the essential Portuguese language course issued by the Employment and Vocational Training Institute (IEFP) or a certificate in essential Portuguese language knowledge after taking an evaluation test of Portuguese as foreign language, recognize by the Ministry of Education; (*)

 

NOTES:

- The applicant must hold a temporary residence permit title for at least 5 years;

- (*) the document delivery may be exempted if the applicant provides a consistent request, as long as its substantiation presents no dubiety.

 

 

Permanent residence permit Renewal (Article 76)

 

The permanent residence permit has no time limit.

 

The residence title must, nonetheless, be renovated every 5 years or whenever an alteration to the identification elements registered on it occurs.

 

 Common Documents:

 

- Request presented in person, in due form, signed by the applicant (in case of a minor or disabled, the request must be signed by the respective legal representative);

- Two recent, identical photographs, in colour with white background, and easily identifiable, if necessary;

- Valid Passport or certified copy (whenever occur uncertainties related to the identity of the applicant or to the absence of National Territory); - Request for search of criminal record by SEF;

- Previous permanent residence title;

- If the request is delivered after the expiry date it shall contain an evidence of permanence in National Territory or corroboration of the absence reasons;
