NATIONALS of the E.U / E.E.S / SWITZERLAND


According to the current Law nº 37/2006, of 9th of August, all the citizens nationals from European Countries that travel to Portugal enjoy the right of entrance, permanence and residence in Portugal, as well as the family members that accompany them or who join them, members of European Economic Space and Switzerland and their family members, as well as the family members of national citizens, independently of its nationality.

Member-States of the European Union: 

Spain, France, Italy, Greece, Germany, Holland, Belgium, Luxemburg, Austria, Sweden, Finland, Denmark, the United kingdom, Ireland, Republic Check, Slovakia, Estonia, Leetonia, Lithuania, Hungary, Poland, Slovenia, Cyprus, Malta, Bulgaria and Romania.

Member-States of European Economic Space: 

Island Liechtenstein, Norway

Entry/Exit from the National Territory


Right of residence in National Territory


Up to three months

The citizens of the EU have the right to reside in national territory for a period up to three months without other conditions and formalities beyond having valid identity card or passport.


More than three months


*Citizens of EU = Certify of Register


The citizens of the Union whose staying in national territory lasts more than three months must formalise their right of residence - Certify of Register - during a period of 30 days after the three months of entry in the national territory.

Necessary documents (to deliver with the proper form in the Delegation of SEF of the area of residence or in the Municipal Council of the residence area – see Adherent Councils):


- Identity card or valid passport;

- Declaration under oath that the applicant fulfils one of the following conditions:


1. Has a professional activity as worker or self employed in Portuguese territory;

2. Has enough resources for him/herself and his/her family, as well as a health insurance, if mandatory for Portuguese citizens in the Member State from his/her nationality;

3. If he/she is registered in a public or private officially recognised school, if proven through a declaration or any other mean of evidence the possession of enough financial resources for him/herself and his/her family, as well as a health insurance, if mandatory for Portuguese citizens in the Member State from his/her nationality;


Rate: 7 euros

 

 

*Family member of a Citizen of EU = Certify of Register


In order to issue the register certificate to a citizen of the Union who resides as family member the following documents are needed (to deliver with proper form in the Delegation of SEF of the area of residence or in the City council of the residence area - see Adherent Councils):

1. A valid identity card or passport;

2. A document proving the family relationship or quality as partner;

3. A register certificate of the accompanied citizen of the Union or to whom is joining;

4. Documental proof that he/her is in ward (for direct descendant under 21 years of age or being in ward to a citizen of the Union, as well as to a spouse or partner and for the direct ascendant in ward to a citizen of the Union, as well as his/her spouse or partner);

5. In cases laid down in n. º 2 of article 3. º (other family members) a document issued by the proper authority from the country of origin or provenance, certifying that he/she is in ward of the citizen of the Union or living with the citizen in partnership, or proving that there are serious health reasons requiring imperatively the personal assistance by the citizen of the Union.

 

Rate: 7 euros.  

 

*Family member of an EU citizen national of a third-State = Residence Card


The Familiar-members of a citizen of the Union national of a third-State whose staying in the national territory last for a period longer than three months must apply for a residence card (this card is issued in the maximum period of three months counting from the presentation of the request).

Necessary documents (to deliver with the proper form in the SEF’s Delegation of the residence area)

 

1. A valid passport;

2. A document proving the family relationship with the citizen of the Union or quality of partnership;

3. Register certificate of the citizen of the Union whom the family members accompany or join;

4. A documental proof that he/she/ is in ward of the citizen of the Union (for direct descendant under 21 years of age or being in ward to a citizen of the Union, as well as to a spouse or partner and for the direct ascendant in ward to a citizen of the Union, as well as his/her spouse or partner);

5. In the case foreseen in n. º 2 of article 30 º (other family members), a document issued by the qualified authority of the country of origin or provenance certifying that he/she is in ward of a citizen of the Union or living with him/her in partnership, or the proof of serious health motives that imperatively require the personal assistance to the family member by the citizen of the Union.

 

Rate: 7euros.

 

 

Permanent residence


*Citizen of the Union and family members from EU =Certify of Permanent Residence

The citizens of the EU and their family members have the right to a permanent residence once they have legally resided in the national territory for a consecutive period of five year. These citizens are entitled and should apply for a Certify of Permanent Residence should be requested.


Necessary formalities:

- Apply for a Certify of Permanent Residence in SEF’s office of the area of residence (in proper form);

(It depends, exclusively, of the verification of the duration of the residence.)

Rate: 7 euros.

 

* Family members of the citizen of the Union national of third-State = Permanent Residence Card

 

The family members of the citizen of the Union national of Third-States have the right of permanent residence once they have resided legally in the national territory for a consecutive period of five year. These citizens are entitled and should apply for a Permanent Residence Card. 
 

Necessary formalities:

- Apply for a Permanent Residence Card Residence in SEF’s office of the area of residence (in proper form)

 

(It depends, exclusively, of the verification of the duration of the residence.)

 

The request of permanent residence card must be presented before the residence card expires.
