Foreign Workeris transcribed:
Without prejudice to what is stipulated regarding the applicable law and with regard to placement of workers, paid labour in Portugal done by a foreign national is subject to what is laid down in this sub-section.
Equality of treatment
The foreign worker who is authorised to take up paid labour in Portugal enjoys the same rights and is subject to the same duties as the worker with Portuguese nationality.
1 - The labour contract signed with a foreign national to do work in Portugal, apart from being in written form must also comply with the formalities laid down in special legislation.
2 – The ruling in this article does not apply to contracts signed with nationals of the member states of the European Economic Area and of those countries that provide the equality of treatment shown to nationals in the free practice of professional activities.
Duty to notify
1 – Signing labour contracts, or cessation of the same, as referred to in this sub-section demands that the competent authority be notified of these deeds, as regulated in special legislation.
2 – The ruling in the previous number does not apply to signing labour contracts with nationals of the member states of the European Economic Area and others in which a similar regime is in force.
The regime in this sub-section applies to the work of those who are stateless in Portugal.
